Acceptable Use Policy

At Sapatana, we thrive to provide the best services and support, but we need to ensure client's follow the AUP.

These Acceptable Use Policy are set for every service and products we offer. Throughout this document, Sapatana shall be referred to as Sapatana.

The following are considered violations of Sapatana Acceptable Use Policy.

General

1.0 - Illegal use

Sapatana's services may not be used for any illegal purposes, or to support any illegal activities. Sapatana reserves the right to co-operate with legal authorities when a investigation of any suspected crime on our servers.

1.1 - Threats

Use of the Sapatana service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of Sapatana or other person's property.

1.2 - Impersonation or Forgery

Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.

1.3 - Fraudulent activity

Use of Sapatana services to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scams.

1.4 - Unsolicited electronic mail

Use of the Sapatana service to transmit any unsolicited electronic mail. Complaints regarding unsolicited electronic mail will be billed at a rate of £40 per abuse complaint Sapatana receives in relation to your use of this service up to a maximum of £1500 in any calendar month. Continuous violations of this type will result in the immediate termination of the offending account.

1.5 - Harassment

Use of the Sapatana services to transmit any material (by e-mail, uploading, posting, etc) that harasses.

1.6 - E-mail / News Bombing

Malicious intent to impede another person's use of electronic mail services or news will result in the immediate termination of the offending account.

1.7 - E-mail / Message Forging

Forging any message header, in part or whole, of any electronic transmission, originating or passing through the Sapatana service is in violation of this AUP.

Everything Else

2.0 - Collection of personal data

Use of the Sapatana service to collect, or attempt to collect, personal information about third parties without their knowledge or consent is forbidden.

2.1 - Copyright or trademark infringement

Use of the Sapatana services to transmit any sort of material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.

2.2 - Unauthorized access

Use of the Sapatana services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Sapatana's or another entity's computer software or hardware, electronic or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending account is subject to immediate termination.

2.3 - Fraud

Involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it.

2.4 - Distribution of Malware

Intentional distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Such an offense will result in the immediate termination of the offending account.

2.5 - Inappropriate Use of Software

Use of software or any device that would facilitate a continued connection, while using Sapatana services could result in the immediate suspension of the offending account

2.6A - Abuse of Services

If a Sapatana customer is abusing our services please send a letter to the address on our about page by clicking here. Also please inform us via the support department where we can receive copies of websites / links to images to prove that you own the copyrighted files / information, etc. Click here to open a ticket. You must also not use 20% or more of system CPU resources (of the main server node where your VPS is hosted at) for longer than 90 seconds.

2.6B - What to include in the Ticket

    Signature of the copyright owner or a individual or entity authorised to act on behalf of the copyright owner ('claimant').
    The name, address and telephone number(s) of the claimant.
    Identification of the infringed copyright work(s).
    Identification of the material which infringes the copyright(s).
    Enough information for Sapatana to locate the infringing material, including the URL of the copyright material, and specific descriptions of the material at each URL. (You can include this in the support ticket)
    A statement that the claimant has belief that the use of the material is not authorised by the copyright(s) holder and/or their agent(s).
    A statement, under penalty of perjury, that the individual or entity is authorised to act on behalf of the copyright owner, and that the information provided in the claim is correct.

Sapatana may revise these Acceptable Use Policy at any time by amending them and posting an up to date copy on the Sapatana Website. Customer should check the Acceptable Use Policy regularly as Customer's use of the Sapatana Website and Services will be deemed an acceptance of the Acceptable Use Policy existing at that time.
